General Terms and Conditions of the SFU Webshop

2. Scope
These General Terms and Conditions apply to all orders placed via the SFU webshop at https://shop.sfu.ac.at.
The SFU webshop is aimed at customers of legal age. It sells merchandise and apparel of Sigmund Freud PrivatUniversität.
Deviating terms of the customer apply only if they have been expressly acknowledged in writing by Sigmund Freud Privatuniversität Wien GmbH.
3. Products and product presentation
The products presented in the webshop do not constitute a legally binding offer, but an invitation to the customer to place an order.
Product images are for illustration purposes. Minor colour deviations may occur, in particular due to different screen displays, and do not constitute a defect, provided the delivered goods otherwise conform to the agreed quality.
Special offers and promotional prices apply only while stocks last and only within the respective stated promotional period.
4. Order and conclusion of contract
Customers can add products to the shopping cart and complete the ordering process via the Shopify checkout.
Before submitting the order, the entered data, products and quantities can be reviewed and corrected. By clicking the "Order with obligation to pay" button, or a correspondingly clear button, the customer submits a binding offer to purchase the goods contained in the shopping cart.
After submitting the order, the customer receives an automated order confirmation by e-mail. This order confirmation confirms receipt of the order but does not yet constitute acceptance of the offer.
The contract is concluded once the order is expressly accepted, the goods are dispatched, or the goods are made available for collection.
Sigmund Freud Privatuniversität Wien GmbH is entitled to reject orders, in particular if products are unavailable, payment problems arise, technical errors occur in the ordering process, or there is a justified suspicion of misuse.
5. Prices and shipping costs
All prices stated in the webshop are gross prices including statutory value added tax.
Any additional shipping costs are displayed in the checkout before the order is submitted. The total price including all stated costs is shown before the order is completed.
6. Payment methods
The payment methods shown in the checkout are available in the webshop. These may include, in particular:
- Credit card;
- PayPal;
- Klarna;
- Apple Pay;
- Google Pay;
- EPS/instant bank transfer;
- Invoice;
- Shopify Payments.
The specific availability of individual payment methods may vary depending on the order, country, payment service provider and checkout configuration.
For payments via external payment service providers, the terms and privacy information of the respective provider apply in addition. Payment processing is carried out by the respective provider.
Complete credit card, account or wallet data is not stored by Sigmund Freud Privatuniversität Wien GmbH, but processed by the respective payment service provider.
For certain payment methods, in particular Klarna, PayPal or purchase on invoice, the respective payment provider may carry out its own payment, risk or credit checks. Sigmund Freud Privatuniversität Wien GmbH does not make any automated credit decision of its own.
7. Delivery, shipping area and collection
Shipping is currently carried out to Austria and Germany.
Shipping is carried out via Österreichische Post AG or a shipping service provider named in the checkout.
Unless a different delivery period is stated in the webshop or checkout, the order is generally processed within a few business days of order confirmation or receipt of payment. Delivery times may vary, in particular during periods of high demand, on public holidays, or due to delays at the shipping service provider.
Alternatively, if offered in the checkout or individually agreed, collection at the SFU is possible. Customers will be informed as soon as the order is ready for collection. Upon collection, an order confirmation or comparable proof must be presented.
Should a product be unavailable, customers will be informed without delay. Payments already made will in this case be refunded, unless an alternative approach is expressly agreed.
8. Retention of title
The goods remain the property of Sigmund Freud Privatuniversität Wien GmbH until full payment has been made.
9. Right of withdrawal for consumers
Consumers have the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which the customer, or a third party named by the customer who is not the carrier, takes possession of the goods.
To exercise the right of withdrawal, customers must inform Sigmund Freud Privatuniversität Wien GmbH by means of a clear statement of the decision to withdraw from the contract. The statement can be made in particular by e-mail or post:

To meet the withdrawal deadline, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the withdrawal period expires.
Customers may use the model withdrawal form set out below. The use of this form is, however, not mandatory.
10. Consequences of withdrawal
If customers withdraw from the contract, we will refund all payments we have received from them, including the costs of standard delivery, without delay and at the latest within 14 days of the day on which we received the notification of withdrawal.
For the refund, we use the same means of payment that was used for the original transaction, unless expressly agreed otherwise. No additional charges will be levied for the refund.
We may withhold the refund until we have received the goods back or until customers have provided proof that they have returned the goods, whichever is the earlier.
Customers must return or hand over the goods without delay and at the latest within 14 days of the day on which they informed us of the withdrawal. The deadline is met if the goods are dispatched before the 14-day period expires.
Customers bear the direct costs of returning the goods, unless expressly agreed otherwise.
Customers only have to compensate for any loss in value of the goods if this loss in value is due to handling that was not necessary to check the condition, properties and functioning of the goods.
11. Exclusion or restriction of the right of withdrawal
The right of withdrawal does not exist, or exists only to a limited extent, in the cases provided for by law.
In particular, the right of withdrawal may be excluded for goods that are made to customer specifications or are clearly tailored to personal needs, as well as for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
For regular merchandise and apparel, the statutory right of withdrawal generally applies, unless a statutory ground for exclusion exists.
12. Model withdrawal form
If you wish to withdraw from the contract, you can use this form and send it to us. The use of the form is not mandatory.

13. Exchange
An exchange, for example for a different size or colour, is voluntary and only possible subject to availability.
Requests for exchange can be sent to merchandise@sfu.ac.at.
Statutory rights of withdrawal and warranty remain unaffected by the voluntary exchange.
14. Warranty
The statutory warranty rights apply.
If the delivered goods are defective, consumers have the rights provided for by law. Voluntary exchange options or goodwill arrangements do not limit statutory warranty rights.
For complaints, please contact merchandise@sfu.ac.at and, if possible, provide the order number and a brief description of the defect.
15. Liability
Sigmund Freud Privatuniversität Wien GmbH is liable in accordance with the statutory provisions.
For damage caused by slight negligence, Sigmund Freud Privatuniversität Wien GmbH is liable only in the event of a breach of material contractual obligations, in the case of personal injury, or insofar as liability exists under mandatory statutory provisions.
Liability for damage resulting from injury to life, body or health, and under the Product Liability Act, remains unaffected.
16. Copyright and trademark rights
All content used in the webshop, in particular texts, images, graphics, logos, trademarks and designs, is protected by copyright, trademark or other law.
Any use, reproduction, modification or distribution is only permitted with the prior consent of Sigmund Freud Privatuniversität Wien GmbH or the respective rights holder, unless permitted by law.
17. Data protection
Information on the processing of personal data in connection with the webshop can be found in our Privacy Policy.
18. Contract language
The language relevant for the conclusion of the contract is German.
19. Applicable law and place of jurisdiction
Austrian law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the state in which the consumer has their habitual residence.
For consumers, the statutory places of jurisdiction apply. For entrepreneurs, the court with subject-matter jurisdiction in Vienna is agreed, insofar as legally permissible.
20. Online dispute resolution and consumer arbitration
The European Commission provides a platform for online dispute resolution, available at https://ec.europa.eu/consumers/odr/.
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board, unless there is a legal obligation to do so.
21. Final provisions
Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions remains unaffected.
Amendments and supplements to these GTC must be made in text form, unless mandatory law provides for a different form. Statutory rights of consumers remain unaffected.
